Terms of Use for AstroPaws Mobile App

Welcome to AstroPaws! These Terms of Use ("Terms") govern your use of the AstroPaws mobile app ("App") provided by BI Enterprises LLC ("we," "us," or "our"). By accessing or using AstroPaws, you ("you," "your," or "user") agree to these Terms. Please read them carefully.


**1. Use of the App & Acknowledgement with Apple**

1.1. **Age Requirement**: AstroPaws is intended for use by individuals who are at least 13 years old. If you are under 13, you may not use the App without parental consent.

1.2. **Non-commercial Use**: You may use AstroPaws for personal, non-commercial purposes only. You may not use the App for any commercial purposes or in any way that violates applicable laws or regulations.

1.3. **Accuracy of Information**: The daily horoscopes and astrological information provided by AstroPaws are for entertainment purposes only. We do not guarantee the accuracy, completeness, or reliability of the information provided.

1.4. **Pet Care**: While AstroPaws may offer general pet care tips and advice, always consult a qualified veterinarian or pet care professional for specific health concerns or care needs for your pets.

1.5. **Apple Acknowledgement**: You and us acknowledge that this agreement is between you and us, not with Apple. We, not Apple, are solely responsible for the AstroPaws app and its content. Any terms within this agreement that conflict with Apple Media Services Terms and Conditions are deemed void and unenforceable.

1.6. Chats and Posts: The App allows users to participate in chats and create posts. All content shared is subject to these Terms, and we reserve the right to review, flag, filter, modify, refuse, or remove any or all content from any chats or posts.


**2. Scope of License & User Account**

2.1. **Registration**: To access certain features of AstroPaws, you may need to create a user account. You agree to provide accurate and up-to-date information during the registration process.

2.2. **Account Security**: You are responsible for maintaining the confidentiality of your account login credentials. You agree not to share your account information with others and to notify us immediately if you suspect unauthorized access to your account.

2.3. **License Limitation**: The license granted to you for the AstroPaws app is limited to a non-transferable license to use AstroPaws on Apple-branded products you own or control. Use must comply with the Usage Rules in Apple Media Services Terms and Conditions.


**3. Maintenance, Support & Warranty**

3.1. **Maintenance and Support**: We are responsible for providing maintenance and support for AstroPaws, as mentioned herein or required by law. Both parties acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for AstroPaws.

3.2. **Warranty**: We, not Apple, are responsible for addressing any product warranties, whether express or implied by law. If the app fails to comply with any warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. Apple has no other warranty obligation related to the app.


**4. Product Claims & Intellectual Property**

4.1. **Claims Responsibility**: We, not Apple, are responsible for addressing any user claims or third-party claims related to the AstroPaws app, including but not limited to: product liability claims, legal or regulatory non-compliance, or consumer protection claims.

4.2. **Intellectual Property Claims**: If a third party alleges that AstroPaws infringes its intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

4.3. **App Ownership**: AstroPaws, its design, graphics, logos, and content, is our property protected by intellectual property laws. No part of the app may be used, reproduced, or modified without our explicit written permission.

4.4. **User Content**: By submitting content, you grant us a non-exclusive, global, royalty-free license to use and distribute it for operating and enhancing AstroPaws.

4.5. User Contributions: When you contribute to chats or posts, you retain your rights to any content you submit, post, or display. By submitting, posting, or displaying content, you grant us a non-exclusive, global, royalty-free license to use, reproduce, process, adapt, publish, transmit, display, and distribute such content in any and all media distribution methods.


**5. Prohibited Activities**

When using AstroPaws, you agree not to engage in the following activities:

5.1. Violations:

Violate any applicable laws, regulations, or third-party rights.

5.2. Unauthorized Access:

Attempt to gain unauthorized access to the App, user accounts, or computer systems.

5.3. Interference:

Interfere with the proper functioning of AstroPaws, including transmitting viruses, malware, or other harmful code.

5.4. Data Scraping:

Collect or harvest data from AstroPaws without our consent.

5.5. False Information:

Provide false or misleading information during registration or usage.

5.6. Objectionable Content: Refrain from posting or sharing any content that is defamatory, offensive, harmful, objectionable, or in violation of any laws or regulations. This includes but is not limited to: hate speech, explicit content, violence, or any form of discrimination.

5.7. Abusive Behavior: Do not harass, threaten, intimidate, impersonate, or try to harm any other users of the App in any way.


**6. Legal Compliance & Termination**

6.1. **U.S. Government Restrictions**: You represent that you are not located in a country subject to a U.S. embargo or labeled as a "terrorist supporting" country. You also confirm that you are not on any U.S. government list of restricted parties.

6.2. **Termination**: We reserve the right to suspend or terminate your access to AstroPaws at any time without notice. You can terminate your use of AstroPaws by discontinuing its use and deleting your account.

6.3. Content Removal: We reserve the right to remove or filter any content that violates these Terms, and to block or permanently ban users who post such content or engage in abusive behavior.


**7. Third Party Rights & Changes to Terms**

7.1. **Apple's Third-Party Beneficiary Status**: You and us acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement. Upon your acceptance, Apple has the right to enforce this agreement against you.

7.2. **Changes to the Terms**: We might update these terms occasionally for various reasons, and we will notify you of significant changes in the app or via email.


8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles.

10. Merchandise Refund Policy

10.1. Refund Eligibility: At AstroPaws, we strive to ensure the satisfaction of our users with the merchandise purchased through our app. However, our refund policy is limited to certain conditions. Refunds for merchandise are only provided in cases where the product is incorrect or defective (“wrong or bad”).

10.2. Incorrect Product: If you receive a product that is different from the one you ordered, please contact us within [a specific number of days, e.g., 30 days] from the date of receipt. You will be required to provide proof of purchase and evidence of the incorrect product (e.g., photos).

10.3. Defective Product: In the case of a defective or damaged product, please contact us within 30 days from the date of receipt. You will need to provide proof of purchase and evidence of the defect or damage.

10.4. Refund Process: Upon verification of your claim, we will initiate a refund to your original method of payment or provide a replacement, at our discretion. Please note that the original shipping charges are non-refundable, unless the return is due to our error.

10.5. Exclusions: Our refund policy does not cover dissatisfaction due to personal preference, minor imperfections that do not affect the product’s functionality, or issues arising from normal wear and tear. Additionally, products must be returned in their original packaging and condition.
